Terms of Service
-
Each painting is an original work created by the Artist. Images and descriptions are provided as accurately as possible. Colours may vary slightly depending on screen settings and lighting conditions.
Unless expressly stated otherwise, the purchase includes the physical artwork only and does not transfer copyright or reproduction rights.
-
Payment must be received in full before artwork is dispatched, unless otherwise agreed in writing.
Orders are subject to availability and confirmation by the Artist. The Artist will notify the Buyer of any significant delay or issue affecting an order.
-
Artwork will be packaged with reasonable care to protect it during transit.
Delivery times are estimates unless a specific delivery date has been agreed. The Buyer is responsible for providing an accurate delivery address.
The Buyer should contact the Artist promptly if the artwork arrives damaged or incorrect.
-
For original paintings purchased online or through other distance-selling arrangements, eligible Buyers have a statutory right to cancel their purchase within 14 days of receiving the artwork, without needing to provide a reason.
To exercise this right, the Buyer must notify the Artist in writing by email at ellasrobinson.design@gmail.com within 14 days of receiving the painting.
After notifying the Artist of cancellation, the Buyer must send the artwork back within a further 14 days, unless another arrangement has been agreed.
For purchases made in person at a physical gallery, studio or other business premises, statutory change-of-mind cancellation rights may not apply. Any voluntary returns offered for such purchases will be subject to the policy agreed at the time of sale.
-
For change-of-mind returns where the Buyer has a statutory right to cancel, the Buyer is responsible for the cost of returning the artwork, provided this has been communicated before purchase.
The Buyer must package the painting securely and use a suitable tracked delivery service. Insurance appropriate to the value of the artwork is strongly recommended.
The Buyer is responsible for any loss in value caused by handling the artwork beyond what is reasonably necessary to inspect it.
Return costs will be covered by the Artist where required by law, including where the artwork is faulty, damaged or not as described.
-
Once a valid cancellation has been made, the Artist will refund the Buyer in accordance with applicable consumer law.
Refunds will include the original standard delivery charge where legally required. If the Buyer selected a more expensive delivery option, the additional cost may be excluded from the refund where permitted by law.
The Artist may withhold the refund until the artwork has been received back or the Buyer has supplied evidence that it has been sent back, whichever occurs first.
Refunds will be made using the original payment method unless otherwise agreed.
-
If a painting arrives damaged, is faulty or does not match its description, the Buyer should contact the Artist promptly and provide photographs and details where possible.
The Artist will work with the Buyer to resolve the issue in accordance with applicable consumer law.
-
Copyright in all paintings remains with the Artist unless a separate written agreement states otherwise.
The Buyer owns the physical painting after purchase but may not reproduce, copy, commercially exploit or distribute images of the artwork for commercial purposes without the Artist's prior written permission.
-
Nothing in these Terms & Conditions excludes, restricts or limits any statutory rights or remedies that cannot legally be excluded, restricted or limited.
The Artist will comply with applicable UK consumer protection legislation.
-
The Buyer is responsible for any customs duties, import taxes, tariffs, handling fees or other charges imposed by the destination country in connection with the delivery of the artwork.
These charges are not included in the purchase price or delivery fee unless expressly stated otherwise at the time of purchase. The Buyer is responsible for checking any applicable import requirements and charges before placing an order.
The Artist is not responsible for delays, additional costs or delivery issues arising from customs clearance or the failure to pay applicable import charges.
If the Buyer refuses to accept delivery or pay the applicable customs charges, the Buyer may be responsible for any resulting return shipping costs, storage fees or other reasonable costs incurred by the Artist, to the extent permitted by applicable law.
